Welcome to CRE8 Finance. These Terms and Conditions ("Terms") govern your access to and use of the CRE8 platform, including our website, mobile application, and related services (collectively, the "Platform"). By accessing or using CRE8, you agree to be bound by these Terms.

1. Overview

CRE8 is a Web3 platform that enables users to tokenize services, manage service-based transactions via smart contract escrow, and interact with a decentralized marketplace built on the Solana blockchain.

2. Eligibility

To use the Platform, you must be at least 18 years old and have the legal capacity to enter into a binding agreement. By using CRE8, you represent and warrant that you meet these requirements.

3. Account Registration

You may access the Platform via:

• Wallet connection (e.g., Phantom)

• Email sign-up or social login (e.g., Google)

You are responsible for maintaining the confidentiality of your account credentials and for any activity under your account.

4. Tokenized Services

Users may mint and sell service-based tokens ("Service Tokens") representing specific offerings (e.g., consulting hours, design work, etc.).

• Sellers must accurately describe their services.

• Buyers agree that purchasing a Service Token entitles them to the stated service, subject to delivery.

• CRE8 does not guarantee the quality or outcome of any service provided.

5. Smart Contract Escrow

CRE8 utilizes smart contract escrow to secure transactions:

• Payments are held until service delivery is confirmed.

• In case of dispute, CRE8 may intervene as a neutral third-party or refer to arbitration procedures as outlined in our Dispute Policy.

6. Fees

CRE8 may charge a service fee or commission on transactions, which will be disclosed at the point of sale or token creation. Blockchain network fees (e.g., Solana gas fees) may also apply.

7. Prohibited Activities

You agree not to:

• Use the Platform for illegal activities

• Impersonate others or misrepresent your identity

• Infringe on any third-party rights

• Engage in fraud or abuse

CRE8 reserves the right to suspend or terminate accounts for violations.

8. Intellectual Property

All content, branding, and technology on the Platform (excluding user-generated content) are the property of CRE8 Technologies LLC and protected by intellectual property laws.

9. Data & Privacy

Our use of your data is governed by our Privacy Policy. By using the Platform, you consent to the collection and use of your information as described.

10. Limitation of Liability

CRE8 is provided "as is." We do not guarantee continuous, error-free operation. To the maximum extent permitted by law, CRE8 disclaims all liability for:

• Loss of tokens, funds, or access due to user error or third-party breaches

• Performance of services purchased on the platform

• Downtime or blockchain disruptions

11. Modifications to the Terms

CRE8 reserves the right to update or modify these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by the laws of the State of New Mexico, USA. Disputes may be resolved in the competent courts of Santa Fe County, NM, unless otherwise stated.
